1. Agreement to Terms
By accessing or using CalBudget ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and CalBudget ("we," "our," or "us"), operated from Seattle, Washington, United States.
2. Description of Service
CalBudget is a web-based calorie tracking application that allows users to:
- Log food items and their caloric/nutritional content
- Track daily calorie intake against personal goals
- View historical data and nutrition patterns
- Export their personal nutrition data
The Service is provided "as is" for personal, non-commercial use.
3. User Accounts
3.1 Account Creation
To use certain features of CalBudget, you must create an account using a valid email address through our authentication provider. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
3.2 Account Termination
You may delete your account at any time by emailing us at calbudget@proton.me. Include the email address associated with your account, and we will process your deletion request within 30 days. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree to use CalBudget only for lawful purposes. You shall not:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
- Upload malicious code, viruses, or harmful data
- Use automated systems (bots, scrapers) to access the Service without permission
- Impersonate another person or misrepresent your identity
- Use the Service to harass, abuse, or harm others
- Attempt to reverse engineer or extract source code from the Service
Violation of these rules may result in immediate termination of your account without notice.
5. User Content
5.1 Your Data
You retain ownership of all data you input into CalBudget, including food entries and calorie information ("User Content"). By using the Service, you grant us a limited license to store and process your User Content solely to provide the Service to you.
5.2 Responsibility
You are solely responsible for your User Content and its accuracy. CalBudget does not verify the nutritional information you enter.
6. Intellectual Property
The CalBudget name, logo, design, and all original content, features, and functionality of the Service are owned by CalBudget and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
7. Health & Medical Disclaimer
IMPORTANT: CalBudget is a tracking tool only. It is NOT intended to provide medical advice, diagnosis, or treatment.
- The nutritional information provided is for general informational purposes only
- Always consult a qualified healthcare provider before making dietary changes
- Do not rely on CalBudget for managing medical conditions such as diabetes, eating disorders, or other health issues
- We make no guarantees about the accuracy of nutritional data from any source
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
- SECURITY OF YOUR DATA AGAINST UNAUTHORIZED ACCESS
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CalBudget AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruption or computer damage
- Health outcomes based on use of the Service
- Any other intangible losses
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $50 USD IF YOU HAVE NOT MADE ANY PAYMENTS.
10. Indemnification
You agree to indemnify and hold harmless CalBudget, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
11. Service Modifications
We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the "Last Updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in King County, Washington.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CalBudget regarding your use of the Service.
